The Labour Court varied decisions on four complaints brought by tyre fitter Vasile Mateiu against Auto Depot Limited, awarding him €1,560 for not receiving a written statement of his employment terms. The Court dated its decision 2 October 2019.
Mateiu said he left in February 2017 because the employer had not provided a contract. Auto Depot said he resigned after a dispute about a pay rise. The Court found he had not made reasonable efforts to address his grievance before resigning, and found no employer conduct that justified constructive dismissal.
The Court found the constructive dismissal complaint was not well founded. It also rejected his claim for unpaid minimum notice, finding he had no notice entitlement after ending his own employment, and his claim that he worked more than the statutory average weekly limit. The terms complaint succeeded because he had not received a written statement; the award was four weeks’ pay.
