The Labour Court upheld a €1,600 compensation award to Carmel O’Brien after employer Justin O’Rourke’s appeal failed. The Court’s determination was dated 26 July 2019.
O’Brien complained that O’Rourke had not given her a written statement of her employment terms. The Adjudication Officer found the complaint well-founded and awarded compensation equivalent to four weeks’ remuneration. O’Rourke argued that because her employment lasted less than two months, he was not required to provide a statement.
The Labour Court held that an employee remained entitled to a written statement even if employment ended before two months’ service. It affirmed the Adjudication Officer’s decision and confirmed the €1,600 compensation.
