The Labour Court dismissed Ulrike Cronje’s appeal against Noonan Services Group Limited, finding that the employer did not breach section 5 of the Terms of Employment (Information) Act. The determination was published in January 2019. Cronje said that, after returning from sick leave, she was directed to work at Noonan’s Pfizer client site instead of the BioMarin site where she had worked before. Noonan relied on her written terms, which said she would be based at its Cork office but could be transferred to other locations in Ireland for business reasons. The Court found the written terms already allowed the transfer, so no change to her statement of terms had occurred. Her appeal failed and the Adjudication Officer’s decision was affirmed.
