The Labour Court varied an award to warehouse operative Wiktor Glogiewicz in his appeal against Team Obair Limited, ordering compensation of 3.4 weeks’ pay for deficiencies in his employment contract. The determination was dated 15 August 2017. The adjudication officer had awarded €1,000, described as 2.3 weeks’ wages; the Court’s varied award was expressed in weeks’ pay.

Glogiewicz said his contract omitted required information about matters including his place of work, start date, pay, hours, leave and pension scheme. Team Obair acknowledged deficiencies in the contract. The Court found that it failed to provide required particulars under several headings, but treated the omissions as one deficient contract rather than separate causes of action for each omission.

The Court considered the extent of the deficiencies, the absence of additional detriment to Glogiewicz and Team Obair’s delay in correcting the contract. It ordered the company to pay 3.4 weeks’ pay for the breach.
