The Labour Court increased Robert Burke’s compensation from €800 to €1,000 after finding that Nurendale T/A Panda Waste had not given him the required written contract particulars. The Court varied the earlier decision in a determination dated 30 March 2016. Burke, a truck driver for the company from May 2007 to July 2014, said he had never received a statement of his contract particulars. The company relied on its induction practice and a signed handbook acknowledgement, but its witness worked in another section of the business at the time. The Court found it was more likely than not that Burke had not received the required statement. It allowed his appeal in part and disallowed the company’s cross-appeal, which challenged the finding and the compensation amount.
