Labour Court overturns decision on Amalia Fagaras’s employment status and awards €1,400

The Labour Court overturned a decision that Amalia Fagaras was not an employee and lacked jurisdiction over her claim, finding that she was employed under a contract of service by Nadias Cleaning Service. The Court awarded her €1,400 compensation.

The Court found the arrangement was more consistent with employment, including because Fagaras was paid a fixed rate and had to carry out assigned duties herself. Nadias Cleaning Service had not provided the required written statement within two months of her employment beginning.

The hearing took place on 9 March 2016, and the determination was signed on 14 March 2016. Fagaras had earned €8 an hour while clients paid €12.50 an hour for the cleaning service.
