Labour Court awards Petrogas worker €850 for Sunday work

Labour Court ·

The Labour Court awarded Edgarus Paulauskas €850 for unpaid Sunday work and ordered Petrogas Group Ltd to apply a Sunday premium of time plus one third. Its determination was dated 29 August 2016. The Court also ordered compensation of €150 for missed daily rest and €250 for missed shop-worker breaks.

Edgarus Paulauskas worked as a junior trainee manager at a motorway service station. The Court found his €22,000 annual salary was not shown to include compensation for Sunday work. It found he was entitled to a one-hour break when working between 11.30am and 2.30pm, but that he could schedule his other breaks himself and Petrogas had not required him to work through them.

The Court also found Petrogas had not given him written notice of a business transfer 30 days beforehand or in good time, and had failed to provide written employment terms within two months. It ordered one week’s wages for each breach. His complaints about notice of shift times and holiday pay were not well founded, so his appeal succeeded in part.
