The Labour Court dismissed John Lyons’s appeal and found his complaint against Noonan Services Group Limited was not well founded. The determination was signed on 3 May 2016. Lyons said he was not given written notice when the company took over his employment in 2009. He had worked for the company since 1995 as a security supervisor. The company said its name appeared on his payslips, but it had no records showing whether written notice was given at the time. The Court noted that Lyons’s pay, hours and other terms had not changed and that he had suffered no detriment. It also referred to the six-year limitation period and said the complaint had no practical consequence. The appeal was disallowed and the Rights Commissioner’s decision affirmed.
