Labour Court overturns decision on Swordlestown Little’s appeal

The Labour Court overturned an adjudication officer’s decision on Swordlestown Little Ltd’s appeal, finding the officer had no jurisdiction to award compensation under a law Markus Pedersen had not complained under. The determination was dated 21 April 2021; the merits of arguments under that law were not decided. Pedersen had complained that his former employer breached rules for mobile road transport workers. The adjudication officer found he was not covered by those rules, but made an award under the Organisation of Working Time Act, 1997. The Court said no complaint had been made under that Act, so the officer could not substitute it for the regulations Pedersen had cited.
