The Labour Court raised a courier driver’s award from €200 to €5,100 after allowing his appeal against Limerick Express Couriers Limited. The determination was dated 2 February 2021.
Mr Malcolm Dick drove evening and night shifts between Limerick and a Dublin depot. He said the company breached rules on working time, night work, breaks and record keeping. The company denied the alleged breaches and relied on tachograph records of his hours and breaks.
The Court found the tachograph records could not establish accurate working hours without sign-in and sign-out records. It accepted Dick’s evidence and found breaches of the rules on working time, breaks, night work and records. The €5,100 compensation was payable within six weeks of the determination.
