Labour Court dismisses Jack Healy’s appeal against Citibus Ltd as out of time

Place: no local area assigned from the source.

The Labour Court dismissed Jack Healy’s appeal against Citibus Ltd because it was lodged outside the statutory time limit. In a determination signed on 29 October 2019, the Court found it had no jurisdiction to hear the appeal, so the merits were not decided. The Adjudication Officer had found Healy’s complaints under the mobile road transport working-time regulations not well founded. Healy said family legal matters, local authority deadlines and other commitments prevented him from appealing within 42 days. Citibus Ltd opposed an extension, arguing those circumstances were not exceptional. The Court accepted that Healy had pressing family matters and had sought legal advice, but found that no exceptional circumstances prevented him from lodging the appeal on time.
