The Labour Court found Robert Burke’s three road-transport working-time complaints not well founded, set aside the earlier decision and awards, and disallowed his appeal while allowing Nurendale T/A Panda Waste’s cross-appeal. The determination was signed on 30 March 2016. The complaints concerned weekly hours, notification of the regulations and access to working-time records. The Court found that after breaks were discounted Burke did not exceed an average of 48 working hours a week; it also found he had been notified of the regulations and had received the only working-time records Nurendale maintained.
