Labour Court ·

The Labour Court raised Aigars Plauka’s compensation from €500 to €1,000 after finding that he was an employee, not an independent contractor. The determination was signed on 14 August 2015. Plauka and his former employer, Stan O’Reilly, trading as C&D RECYLING, brought a joint appeal.

The Court found Plauka’s working-hours complaint not well founded, relying on records it considered accurate. It also found the breaks complaint not well founded because the records showed he did not work after 5pm during the relevant period. The daily-rest regulations provided no route to make a complaint about the alleged breach.

The Court upheld the complaint that the employer had not given Plauka a copy of the regulations and increased the award for that breach to €1,000. It found his records complaint not well founded because the employer had no chance to respond to the records request before the complaint was referred. The appeals succeeded in part.
