The Labour Court awarded driver Andrzej Grabowy €300 after finding MDS Distribution Ltd required him to work six hours beyond the weekly limit in March 2014. The Court dated its determination 5 August 2015. The Court found Grabowy worked 62 hours in the week beginning 9 January 2014 and 66 hours in the week beginning 4 March 2014. The January breach was outside the time limit, while the March breach was within time. It found his average working time was below the limit. A separate appeal under the Organisation of Working Time Act 1997 was withdrawn. The Court allowed the appeal to the extent of the March breach and amended the Rights Commissioner's decision. MDS Distribution Ltd did not attend the hearing.
