The Labour Court dismissed Ainars Lucens’s appeal and upheld the Rights Commissioner’s decision, including awards of €1,000 each for breaches of working-time and break rules and €600 for a records breach. The determination was signed on 15 October 2014.
Lucens also appealed the finding that Nurendale Limited T/A Panda Waste had met the notification requirement. The Court found a document provided around April 2013, together with information given during initial training, was sufficient. Panda Waste accepted the three other breaches and told the Court it had reorganised management and introduced measures to prevent a recurrence. Lucens argued the compensation was too low to deter further breaches, but the Court found no basis to change it.
