The Labour Court overturned a decision denying Nora Boggans a redundancy payment, finding that the childcare assistant job offered after her workplace closed was a clear downgrade from her assistant manager role. The determination was dated 11 March 2021.
Cosy Tots & Co Ltd T/A Tots & Co said the alternative role had the same pay and terms and was suitable. Boggans argued that it meant a loss of status and a move from Nutgrove to Barrow Street. The Court found that the reduction in status and responsibilities gave her reasonable grounds to refuse it, so a redundancy payment based on her service was payable.
