The Labour Court upheld Yvonne Healy’s redundancy entitlement on L Connaughton and Sons Limited’s appeal. Its determination was dated 16 October 2020.
Healy worked as an office administrator at the company’s Grand Canal Quay warehouse. After the business moved to Clonshaugh, she could no longer commute by train and sought redundancy. The company argued the new site was within 10km and offered to collect her from a train station.
The Court found there was no mobility clause in Healy’s contract, which specified Grand Canal Quay as her workplace. It said the move to a site without train links, considerably further from her home, was a major change to her employment terms and was not suitable alternative employment in the same place.
The Court set Healy’s final weekly wage at €488.90 and confirmed her entitlement to a redundancy payment based on that wage and 15 years and three weeks of service.
