The Labour Court reduced Mary O’Reilly’s redundancy payment from €7,648 to €5,858.60 after her former employer, Tarossa Frehill Ltd, appealed. The determination was dated 19 August 2020. Tarossa Frehill, which operated a Spar store, argued that O’Reilly had been laid off while a new owner was found and disputed the original calculation. O’Reilly said she received no lay-off notice and had requested redundancy payment in a letter dated 7 December 2017. The Court accepted that she hand-delivered the letter and found that, without proof of the required lay-off notice, her role had been made redundant. It calculated weekly earnings at €306.74 based on the preceding 52 weeks and varied the adjudication officer’s decision accordingly.
