The Labour Court upheld the €240 weekly wage used to calculate Jerko Anders Hresic Bernak’s redundancy payment, rejecting his appeal for a higher figure. The determination was dated 1 April 2019.
Hresic Bernak appealed the Adjudication Officer’s decision, which had found in his favour and calculated his redundancy payment using weekly pay of €240. He argued that he earned €600 a week, or alternatively that his pay should be calculated at €9.15 an hour for 57.5 hours, or €526.15 a week. Hannigan Butchers Limited did not attend either hearing.
The Court accepted that a redundancy had occurred but found Hresic Bernak had not proved earnings above €240 a week. His payslips and P60 records supported that figure; sporadic bank lodgements were not firm proof of higher earnings. The Court upheld the Adjudication Officer’s decision.
