Labour Court affirms dismissal of Valerie Daniels’s redundancy claim as out of time

The Labour Court disallowed Valerie Daniels’s appeal and affirmed the dismissal of her redundancy payment claim against Fitzers Catering Limited. The determination was dated 28 February 2017. Daniels said she believed her work had transferred to Aramark Catering after Fitzers lost its Croke Park catering contract. The Court considered that belief reasonable in light of the messages and meeting arrangements, and the lack of clear communication that choosing Aramark would count as a resignation. It accepted reasonable cause for her initial delay, but found no justifiable explanation for the further delay after she sent Fitzers a form on 23 March 2015 and referred her claim to the WRC on 26 November 2015. The merits of her redundancy claim were not decided.
