The Labour Court set aside an adjudication officer’s decision in Christina Gill’s favour after finding that the motor-factors business she worked for had transferred to a new employer. The Court found her redundancy claim not well-founded in its determination dated 10 November 2017.
Gill worked as an office administrator for Ardcolum Motor Factors Limited for about five years. Ardcolum Agri Stores Limited continued the core business from the same premises, serving the same customer base and using key machinery. Three former employees worked for the new business, on terms no less favourable than before.
The Court found that the transfer took place on 7 December 2015. It concluded that Gill’s job was deemed to continue, so she was not entitled to statutory redundancy pay from her former employer.
