The Labour Court refused Georgie Davis an extension to appeal a redundancy decision outside the statutory time limit, leaving it without jurisdiction to hear the appeal. The merits were not decided. The determination was signed on 13 October 2017. Davis cited personal circumstances affecting his counsel and the solicitor’s principal being on annual leave. Boxmore Plastics Limited objected. The Court said the appellant had to provide clear and convincing evidence of exceptional circumstances that prevented a timely appeal, and did not accept counsel’s unavailability to complete the form as grounds for an extension.
