The Labour Court awarded Frank Dunne €405 for underpaid wages and Dave Kearney €5,922 in travel pay in a decision dated 14 February 2012. The Services Industrial Professional Technical Union brought the complaints against C & M Construction Limited under a registered employment agreement. The Court rejected the company's argument that Dunne's higher pay in 2008 and 2009 should offset the later shortfall, despite its 10% pay cut. It found Kearney was entitled to one and a half hours' travel pay per working day for work at Dublin Airport. The union's separate complaint that the company breached the agreement's dispute procedures was not well founded because the CIDT process had not been completed. The Court recommended referring that issue to the CIDT for prompt completion.
