The Labour Court found that Gem Construction Company Ltd had not breached the construction industry agreement’s dispute procedure in a complaint brought by the Building and Allied Trades Union. Its decision was signed on 18 August 2011. The union said Gem failed to meet within seven days of its first letter. Gem said it had not refused to meet, and the Court found the company responded within a week and engaged with the process. The union referred the matters to the Construction Industry Disputes Tribunal about seven months after first raising them with the company.
