Labour Court recommends €73,304.68 payment by Conneally Painting Contractors

Labour Court ·

The Labour Court recommended that Conneally Painting Contractors Ltd pay €73,304.68 in arrears for pension, assurance and sick-pay contributions under the construction industry agreement. The recommendation was signed on 15 December 2009. The Construction Industry Federation said the company had failed to enrol covered employees in the required scheme. The company disputed the amount and argued that it was not required to make retrospective contributions. It also challenged how the summons was served and the Federation’s authority to bring the complaint. The Court rejected the company’s objections, finding the complaint clear, the Federation an authorised employers’ representative and retrospective correction permissible. The company did not provide its own calculation of the amount owed when invited, and the Court recommended payment in the terms sought by the Federation.
