The Labour Court found a union complaint against Sean O'Brien T/A Sean O'Brien Painting Contractor was not well founded. The decision was signed on 1 September 2006. Inp&DTG alleged a breach of the construction industry agreement on pensions, assurance and sick pay, arguing that another painter working at RTE was an employee covered by it. The respondent said the painter took on contract work that he could not complete himself. The Court found no evidence to contradict that account and could not hold that the painter was a worker or employee under the agreement. It also found that preparing television programme sets was outside the agreement’s scope.
