The Labour Court found Site Investigations Limited was not covered by the construction industry Registered Employment Agreement on pensions, assurance and sick pay, and could not be in breach. The decision was signed on 28 August 2006. Inp&DTG said the company carried out civil engineering and construction work on site. The company said it conducted site investigations to assess land before construction and relied on an agreement with the then Irish Transport and General Workers' Union that it was not covered. The Court was not satisfied the company was a building or civil engineering firm within the agreement's meaning, and found the complaint not well-founded.
