The Labour Court dismissed a complaint by the Irish National Painters & Decorators Trade Group over Grogan Engineering Limited’s use of the Construction Industry Registered Employment Agreement on pensions, assurance and sick pay. The decision was signed on 8 June 2004. The trade group said the company’s work on building sites meant it should register employees in the construction industry scheme. Grogan Engineering manufactured metal products and employed 27 people, none of whom were described as craftsmen or construction operatives under the agreement. The Court found the company was not a building or civil engineering firm covered by the agreement and could not be required to apply its terms to employees.
