The Labour Court found that McCarthy Sweeper Hire Limited had not breached the construction industry Registered Employment Agreement on pensions, assurance and sick pay. The decision was signed on 12 May 2003. The Irish National Painters&Decorators Trade Group said the company should register its employees in the industry scheme because it operated on building sites. The company said it swept and cleaned roads, spent about 40% of its time on construction sites and had its own pension and sick pay schemes. The Court considered this evidence before finding it was not satisfied that the agreement had been breached.
