The Labour Court recommended that Ariane Floor Sanding Specialists was not in breach of the construction industry Registered Employment Agreement. The recommendation was signed on 7 January 2003. Inp&DTG/SIPTU alleged the agreement applied because the company replaced floors. The company said it sanded and polished them. The Court found it sanded floors and did not replace them, so its work did not come within the agreement.
