The Labour Court varied an adjudication officer’s decision and ordered Ming Feng Limited to pay Jinxiu Zheng €656.05 compensation for an unlawful wage deduction. The decision was dated 29 October 2024. The adjudication officer had previously ordered €250.
Zheng, a sous-chef, said he was paid €300 a week in cash and that deductions for taxes and living expenses were made without his agreement. The company did not attend the hearing. The Court found that €1,361.33 gross was properly payable for the relevant period, while Zheng received €500 in cash, and found no evidence that the deduction was authorised by law, contract or his prior written consent.
The Court found an unlawful deduction that left a €656.05 shortfall and awarded the same amount as compensation. It partly upheld the complaint and varied the earlier decision.
