The Labour Court rejected Paul O’Sullivan’s appeal over his pay rate, upholding the finding that his complaint against Apple Operations Europe Limited was not well founded. The Court’s determination was dated 26 July 2023.

O’Sullivan argued that his long-term flex contract entitled him to the higher rate paid to permanent assemblers. He said they received €1,671 more per year. Apple said it paid him the rate for his contract and that he was not part of the red-circled group whose existing terms were protected.

The Court found that O’Sullivan had received what was properly payable under his contract and the collective agreement. Documents describing him as permanent did not establish that he belonged to the red-circled group. The appeal failed, leaving the original decision in place.
