Beaumont Hospital overturned a €11,891.28 award to former Senior Clinical Engineer Gareth Enright after the Labour Court allowed the hospital’s appeal. The Court dated its determination 11 July 2022.
Enright’s complaint said he was not paid the correct out-of-hours call-out rate. He argued that an HSE circular entitled him to a backdated standby allowance and that the breach date should be when he received his payslip. The hospital said the circular did not apply to his grade and no breach occurred during the period the Court could consider.
The Court found Enright had not identified a breach within that period. He had left the hospital on 24 July 2020, and his final payment on 31 July covered work from 1 to 24 July. The Court said he knew negotiations on a revised call-out arrangement had not concluded when he left. It set aside the adjudication officer’s award.
