The Labour Court upheld a decision that the WRC lacked jurisdiction to hear Stephen NG’s Payment of Wages Act complaints against Moanne Chow T/A Orchid Restaurant. The determination was signed on 31 March 2021; the merits were not decided. Ng said Chow employed him and had not given him written employment terms. Chow said she was a part-time manager and that MCF Catering Ltd was his employer. The Court said the lack of written employment documentation made it difficult to identify the employer, but accepted, with some reservation, that the balance of documentary evidence favoured Chow’s position.
