The Labour Court upheld the rejection of chef Mickael Jego’s €10,000 overtime claim against Compass Catering Services Ireland Limited. Its determination was signed on 31 August 2021.

Jego said he worked five to 10 extra hours a week without pay and had sought a replacement clock card after losing his. Compass said overtime had to be authorised in advance and argued that the amount claimed was implausible compared with the overtime previously paid.

The Court found no record of the hours Jego claimed and no documentary proof that he had asked a company representative for a replacement card. It accepted there had been some informality in allocating overtime, but said it needed more evidence to find, on the balance of probabilities, that he had worked the hours claimed. The Court did not uphold the claim and affirmed the adjudication officer’s decision.
