The Labour Court varied an earlier decision and directed L Connaughton and Sons Limited to pay Yvonne Healy €488.80 in unpaid wages, subject to lawful deductions. Its determination was dated 16 October 2020.

Healy, an office administrator, said she accepted a 4% pay increase in September 2016, but it was never applied. The company appealed the original ruling, arguing the claim was out of time and that it was unclear whether she had accepted the increase. At the hearing, its representative agreed that the increase had been offered and accepted.

The Court found that the increase formed part of Healy’s contracted wages and that the failure to pay it continued until her employment ended. It considered the six-month period from 30 July 2019 and calculated the shortfall at €18.80 a week for 26 weeks.

The Court varied the Adjudication Officer’s decision to €488.80, payable subject to lawful deductions.
