The Labour Court upheld the Adjudication Officer’s decision that Gerry Hanna’s complaint against the Financial Services Union was not well founded, and Hanna’s appeal failed. The determination was signed on 13 January 2020.

Hanna argued he was fit to return to work from March 2018 but was not allowed back until October, leaving him short of €7,540 in wages. The union said its income continuance policy entitled him to 75% of normal wages, less social welfare benefits, while he was absent.

The Court found that Hanna’s contract provided no entitlement above the policy payment during his illness absence, and that his entitlement to full pay began when he returned to work.
