The Labour Court upheld an appeal by Dublin and Dun Laoghaire Education and Training Board, setting aside a decision in Ronan Flynn’s favour. The determination was signed on 10 July 2018.
Flynn, a teacher, claimed a €796 supervision and substitution allowance and salary increments to €31,903 and €32,806 under the Lansdowne Road Agreement. The Board argued that he was paid the salary properly payable under the statutory framework and Circular 0045/2016. The Court found Flynn was not a TUI member and that the agreement’s terms applied to members of affiliated unions, so the claimed sums were not properly payable to him. It found no unlawful deduction from his salary and set aside the Adjudication Officer’s decision.
