The Labour Court upheld Robert Nagle’s salary claim against M & J Gleeson & Co T/A C&C Gleeson, finding that his gross monthly salary of €3,440.67 was properly payable. The determination was signed on 29 January 2018, after the employer appealed the Adjudication Officer’s decision.
The Court said the shortfall caused by the salary reduction should be back paid to May 2016. It also awarded Nagle €1,832.40 for overtime within the cognisable period. The employer had argued that the higher salary was temporary or an overpayment, but the Court found no evidence to support the latter claim.
The Court had no jurisdiction over Nagle’s fixed-expenses claim because expenses are not wages under the Act.
