The Labour Court rejected Brendan Lane’s appeal over a weekly deduction from his Defence Forces pay, finding it did not breach the Payment of Wages Act. The Court’s determination was dated 19 April 2018.
Lane argued that he paid for services he did not receive. The Department of Defence (Minister for Defence) said the deduction was authorised under regulations and contributed to welfare expenses. The Court found it was authorised by regulations made under statute and fell within an exception in the Act. It said it was not its role to examine how the money was spent. The appeal was not allowed, and the Adjudication Officer’s decision was affirmed.
