The Labour Court upheld a 32-cent gross hourly pay increase for Michael Flaherty on Noonan Services Group Limited's appeal. The determination was dated 28 March 2018. The increase applied to each night-shift hour worked in the cognisable period from 3 May to 2 November 2016. Flaherty said his night-shift rate was linked to the basic rate and should have risen when an Employment Regulation Order took effect on 1 October 2015. Noonan said it understood the night-shift rate to be a specific payment and knew of no agreement requiring it to rise automatically. The Court said earlier increases had maintained the difference between the night and day rates, and Noonan's due-diligence records suggested both rates had been adjusted under the order.
