The Labour Court upheld a €1,682 award to Patrick Mc Loughlin and awarded him a further €1,200 in a wages appeal by CLS Recruitment Group Limited. The determination was signed on 2 August 2017.
Mc Loughlin said the company had reduced his agreed net rate of €120 a day. The Court found there was no statutory or contractual basis for the reduction and affirmed the adjudicator’s compensation award. CLS said it reduced his pay to align it with his tax status.
The Court also found Mc Loughlin remained employed during two disputed weeks in December 2015 and was owed wages for work performed, awarding €1,200 net. A separate night-shift complaint could not be appealed because the adjudicator had made no decision on it; the Court said the matter had been addressed between the parties.
