The Labour Court upheld a €1,032 award to Sandra Gilger after rejecting Brid Jackson T/A The Mulberry Tree Learning Centre’s appeal. Its determination was dated 19 April 2016.

Gilger said her contracts set gross weekly pay at €443, but she received €400. Jackson said the contracts mistakenly included €43 for employer PRSI on top of her €400 weekly salary. The Court noted that the second contract, still showing €443, was signed by both parties on the day Jackson said she explained the error.

The Court limited the claim to the period from 26 December 2014 to 15 June 2015, agreeing that an extension of time for earlier deductions was not justified. It found the contract sums were payable during the period it could consider and directed payment of €1,032 compensation within six weeks.
