The Labour Court overturned a €6,092 award to Angela Lally after upholding Intec Billing Ireland’s appeal over statutory notice pay. The determination was signed on 28 October 2016.
Lally had argued that the company unlawfully withheld eight weeks’ notice pay. The Court found she was not fit to work during the notice period and was therefore not ready and willing to work. It concluded that the company had no obligation to pay her for that period and that there had been no unlawful deduction from her wages.
