Labour Court sets aside wage ruling and awards Dunnes Stores worker €300

The Labour Court set aside a decision against Patrycja Jakubiec Burzawa and directed Dunnes Stores to pay her €300 in compensation. The determination, signed on 6 October 2016, allowed her appeal over €61 in unpaid wages.

Burzawa was rostered for a night shift that crossed the end of a strike on 2 April 2015. Dunnes Stores refused to let her work the remaining rostered hours or pay her for them. The company argued that her offer to work after the strike was only partial performance of her contract.

The Court found that Burzawa had offered to perform all her remaining rostered duties after the strike. It found no basis for cancelling her roster and held that the €61 was properly payable. The failure to pay it was an unlawful deduction under the Payment of Wages Act 1991.
