The Labour Court left a €250 award to Svitlana Demenko in place and dismissed her appeal over a €2,400 wages claim. The determination was signed on 22 February 2016. Dilion & Co Limited had given Demenko two weeks’ written notice when it decided to reduce staff because of difficult trading conditions. The Rights Commissioner had awarded Demenko €250 for the employer’s late statement of employment terms. The Labour Court found no reason to increase the compensation, noting that the other alleged defects caused no actual loss or detriment. Demenko argued her contract ran until 31 December 2014 and sought €2,400 for the remaining ten weeks after her dismissal. The Court said she received written notice and dismissed the Payment of Wages appeal. It did not decide whether her contract was fixed-term because no claim under that law was before it. She withdrew her appeal over notice of her daily start and finish times. The Court also dismissed her claim for annual leave and public-holiday pay through December, which depended on the wages appeal succeeding.
