The Labour Court upheld the decision that James Deeney’s Payment of Wages Act complaint was out of time and rejected his appeal. The determination was signed on 11 August 2016. The Court found the complaint was brought outside the time limit and was not well founded; the merits were not decided.
Deeney said the Department of the Environment, Community & Local Government and the Department of Public Expenditure & Reform unlawfully deducted contributions to the Civil Service Spouses and Children Superannuation Scheme from his salary. He challenged deductions made between August 1988 and his retirement in June 2006.
He argued that a ministerial refusal in October 2015 to refund the contributions brought his complaint within the time limit. The Court found that the refusal could not count as a deduction from wages and that Deeney had referred his complaint almost ten years after the last deductions.
