The Labour Court rejected teacher Martin Lynch’s appeal over a claimed €1,769 supervision and substitution allowance from St Michaels College. In a determination dated 9 May 2016, the Court found he was not entitled to payment for duties he had neither agreed to undertake nor performed, so the non-payment was not a deduction from his wages. It found the complaint was not well founded and did not allow the appeal. The Court did not address the school’s other arguments that it was not his employer for the purposes of the Act and that the complaint was out of time.
