The Labour Court ruled that Teresa Igoe’s appeal against Kildare & Wicklow Education & Training Board (Kwetb) over a part-time work complaint was out of time and that it had no jurisdiction to hear it. The determination was signed on 10 August 2016. The appeal deadline was 2 May, but the Court received Igoe’s appeal on 4 May. It found that illness, a one-day deadline miscalculation, a cancelled meeting, bank holidays and expected postal delivery did not prevent timely notice. The merits of the underlying complaint were not decided.
