The Labour Court determined that Irish Museum of Modern Art Company had failed to implement a Rights Commissioner’s decision in Joe Stanley’s case. In a determination signed on 22 February 2016, it required the company to comply with the Act and pay compensation equal to any loss Stanley sustained from 7 September 2013 until it complied with the earlier decision.
Stanley brought the case under the Protection of Employees (Part-Time Work) Act, 2001. The Court noted that no appeal had been brought against the Rights Commissioner’s decision within the time limit. The compensation was tied to any loss he sustained; the determination did not state a fixed sum.
